I have good law office with all modern facilities in India and have a very good team of lawyers with me.We are into legal consultancy, documentation, drafting etc. for the last 10 + years. We can undertake outsourcing jobs in a timebound manner to the statisfaction of the client. We want to be into the emerging LPO market in India and seek advice as to how to start with.

Question by ARNICA: Is the payroll function best performed within a company, or is outsourcing a better approach to payroll proces?

I think that such private process should be done within the company. I am not a supporter of outsourcing because it gives information about the company which can lead to more competition. The payroll process should be done by selective people who can be trusted to be honest and accurate, by doing it within the company.

Question by syldav33: How can I set up a Data Entry Company (for outsource work)?
I am interested in setting up a data entry company to accomodate local businesses that outsource this type of work. I have no idea where to begin. If you have ever done something similar, please help me out. I know I would be able to recruit the work force and the work, but i am at a loss for the legalities. Also, I guess i’m afraid of the UNKNOWN (things I may have to do but am unaware of). Please Help!

1.) In the first place you have to register a “Private Limited” company to limit your legal obligations to the equity of this company. Wrong data entries could result in losses that could be charged back to you.
2.) Secondly you need to get a lawyer to help you establish this company, draw up your standard contracts under which you take up the outsourced work as well as the employment contracts.
3.) Thirdly, a tax adviser who will give you all required details to avoid any wrong entries from day one. This is also important for your calculation of operational prices under which you can take on a contract.
4.) Analyse the software requirements for the various companies, if you will need to purchase on your own (expensive!) or if the respective company needs to provide, e.g. through a direct access link.
5.) Office space, if required. Make sure you have a flexible rental agreement so that you can adjust according to your development of work.
6.) Give yourself enough time to have all up and running before actually starting the work. Often people fail because they first start and then do the important things – and fall into all these legal and regulatory traps.
